Terms of Service

The short version: You own everything you create. We provide the workspace. You can leave anytime and take everything with you.

1. Agreement

By using Sakme ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. The Service is operated by Agent-C LLC ("we," "us," or "our").

2. Your Creative Work

2.1 You Own Your Work

All creative content you produce using Sakme belongs to you. This includes stories, scenes, characters, world-building, voice profiles, and any other creative output. We claim no ownership, license, or rights to your creative work beyond what is necessary to provide the Service.

2.2 Your Workspace Data Belongs to You

The saved context, preference signals, and continuity data associated with your account belong to you and are used to operate and improve your experience inside your workspace. We do not claim ownership of that data beyond the limited rights needed to provide the service.

2.3 License to Provide the Service

To operate Sakme, you grant us a limited, non-exclusive license to process your content as needed to provide the Service (e.g., sending prompts to AI models, storing data, generating outputs). This license terminates when you delete your account.

2.4 Marketplace Content and Publication Records

If you publish content, capabilities, or templates through Sakme, you retain ownership and grant the rights needed to distribute that content through the relevant product feature. Some publication or attribution records may remain persistent once content has been published or distributed.

2.5 Account and Credential Responsibility

You are responsible for maintaining the security of your account, your connected sign-in methods, and any external credentials or provider keys you choose to use with the service. We are not responsible for loss caused by your failure to secure those credentials.

3. Accounts

3.1 Eligibility

You must be at least 16 years old to create a Sakme account. By creating an account, you represent that you meet this requirement.

3.2 Account Security

You are responsible for maintaining the security of your account. Sakme uses third-party authentication (Google OAuth) and does not store passwords directly. If you believe your account has been compromised, contact us immediately at security@sakme.ai.

3.3 One Account Per Person

Each person should maintain one account. Multiple accounts for the same individual may be consolidated or removed.

4. Subscription Tiers

4.1 Free Tier

The free tier provides limited access to Sakme features as described on the pricing page. Some features may require you to provide your own third-party credentials or keys.

4.2 Paid Tiers

Paid subscriptions, including tiers such as Making, Meaning, and Mastery, are billed through our payment provider. Prices and feature availability are described on the pricing page and may change with notice. You can cancel at any time, and your subscription remains active until the end of the current billing period.

4.3 Refunds

We offer a full refund within the first 14 days of a new subscription. After 14 days, refunds are handled on a case-by-case basis. Contact billing@sakme.ai.

5. Acceptable Use

5.1 Permitted Use

Sakme is designed for creative work — writing, storytelling, content creation, and related creative activities. You may use the Service for personal and commercial creative projects.

You may not use Sakme to:

Content generated through Sakme's AI features is your responsibility. You are responsible for reviewing and approving any content before publication, distribution, or reliance. AI-generated content should be labeled where required by law or platform policy.

6. Data Portability and Deletion

6.1 Right to Data Portability

You may export your available workspace data in the formats we support at the time of export. We will not make reasonable data export contingent on maintaining a paid subscription beyond what is necessary to verify account ownership or complete the export securely.

6.2 Delete Your Account

You may request account deletion through available account controls or by contacting us. Upon deletion, we remove or schedule removal of your account data in accordance with our Privacy Policy, except for records we are required to retain or records that are already persistent because of publication or distribution features.

6.3 The Right to Leave

We believe the right to leave with your data intact is fundamental. Sakme is built on an open-source engine (Seitiate). If you choose to leave, you can export your data and, if technically inclined, run the open-source engine yourself. We will never hold your data hostage.

7. Open Source

Sakme's underlying engine, Seitiate, is open-source software licensed under AGPL-3.0. The terms of the AGPL-3.0 license apply to the engine source code. The Sakme experience layer (user interface, managed hosting, marketplace) is proprietary and subject to these Terms.

8. Intellectual Property

8.1 Sakme IP

The Sakme brand, user interface design, managed infrastructure, and proprietary product features are the intellectual property of Agent-C LLC and its licensors.

8.2 Open Source Credits

Sakme is built with numerous open-source technologies. Attribution and license information for all open-source dependencies are available in the Seitiate repository.

9. Limitation of Liability

Sakme is provided "as is" without warranties of any kind. We do our best to keep the Service reliable and your data safe, but we cannot guarantee uninterrupted service. To the maximum extent permitted by law:

10. Changes to Terms

We may update these Terms with 30 days' notice via email and/or in-app notification. Material changes (pricing, ownership rights, data practices) require affirmative consent. Continued use after the effective date constitutes acceptance of non-material changes.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
